Terms for venues
Last updated 29 October 2026
These terms are the agreement between Schwifty and a place on it: a bar, a restaurant, a club, a climbing gym, a court, a studio, a museum or any other business where groups make plans (“your place”, “you”). Your place accepts them when it joins Schwifty, on our website or in the app, and they apply to everything it does on Schwifty. A place that joined before them is bound by them from 1 December 2026, or from when it accepts them, if sooner. Whoever runs your place in the app does so from their own account, under the terms of use and the community guidelines too, and the privacy policy explains what we do with personal data.
Schwifty is run by Miguel Castellano Merino, in Italy (“we”). Write to us at support@schwifty.eu, in English, Italian, Spanish or German.
What Schwifty does for your place
Schwifty is an app where people make plans together: they pick the plan and the people, and often a place. Plans are made by people, never by places. When a group plans to come to your place, Schwifty helps it get there and lets you know it’s coming. With your place on Schwifty, the people who run it can:
- answer hosts’ requests to book for their groups, in one tap, in the app or on your place’s own page on our website;
- see every Schwifty group coming, tonight and in the next two weeks, with its host’s first name, how many and when;
- post your events, once or every week, each with its own page, for groups to make plans for;
- make offers to groups, such as at your quiet hours: to every Schwifty group, to members (people with the badge of a company on Schwifty), or to the people of one company whose people come;
- give your regulars a perk you choose, which your staff see when a regular’s group shows its code;
- scan a group’s code where it pays, to see whose group it is and count how many came;
- add your staff, each on their own phone;
- see your numbers (below).
Groups can plan at your place without it joining: any place in the public map data can be picked for a plan, and its page on schwifty.eu shows counts from the plans held there. These terms are for places that join.
Joining
Your place joins by proving it’s itself, with a code we send to the number on its public listing in the map data: by text to a mobile, or read out in a call to a landline. Whoever enters the code runs your place on Schwifty, as a manager. Only someone who may act for your place should join it. Managers add others, as managers or staff, with a link that works once, for a week, and can take them off. You’re responsible for whom you let run your place on Schwifty, and for what they do there for it.
Your place’s name, address, phone number and website come from its public listing in the map data, its email from there or from its own website, and its photos from Google Maps, shown under Google’s terms. If any of it is wrong, tell us.
What it costs
Everything in these terms is free: joining, your page, bookings, events, offers, a perk for your regulars, your numbers, and being shown to groups. No place pays to be shown, or to be shown higher.
Founding venues. Every place that joins while Schwifty is in beta is a Founding venue: its pages say so, and we send it a window sticker. For a year after Schwifty’s public launch, a Founding venue pays no fees for anything in these terms. Payments through Schwifty aren’t in these terms yet: what they’ll cost, a Founding venue’s first year included, will be added before any place can take them (see Payments).
What you post
What your place posts on Schwifty, its events with their words and photos, its offers, its perk and its answers to bookings, must be true and current, yours to post, and within these terms, the community guidelines and the law. In particular:
- An event happens as posted, or you change it or call it off in time. Its price is the real one, and so is who it’s for (everyone, 18+ or 21+).
- An offer or a perk is given as posted, to the groups it’s for, while it holds: pause or end it rather than turn a group down.
- Confirm only bookings you can keep, and count groups as they are when you scan their codes.
- Use what you see about groups (a host’s first name, how many, when) only to welcome them.
- Nothing misleading, and no advertising for other businesses.
An event’s words and photo are checked automatically when it’s posted, and anyone can report one; a person on our team looks at every report, and decides.
What your place posts stays yours: its name and logo, its photos and its words. You give us a free, non-exclusive licence to store them, to show them on Schwifty and where these terms say (below), and to make the copies needed for that (smaller versions of photos, for instance), for as long as they’re on Schwifty. It ends when you or we take them down, or when your place leaves; copies in backups are gone within 14 days. A link or a story someone already shared stays where they shared it.
Schwifty’s name, logo, app, website and window sticker are ours. While your place is on Schwifty, you may show the sticker and say that it is.
Where your place shows
- In the app: in Discover (its places, events and offers), where hosts pick a place for a plan, in search, and on the plans at your place.
- On our website: your place’s page (schwifty.eu/v/…), your events’ pages and the booking pages hosts send you. Search engines may list an event your place posted while it’s still to come; never your place’s page.
- In what people share: links to your events and your page, with their previews, and the pictures people post as stories (on Instagram, for instance).
We don’t market your place anywhere else, and there are no affiliate programmes. A company on Schwifty can also show its people a deal it has with your place, in its own words; if one isn’t right, tell us and we take it down.
How places are ordered
Where Schwifty suggests places, it orders them for each person looking, from what Schwifty knows. Nobody pays for any of it.
Where hosts pick a place for a plan, and when someone searches for something to do:
- Before the rest, up to eight places the person knows: where their own plans went in the last 12 months, the most first, then their friends’ favourite spots, the most friends first.
- Then the places that fit the plan. First, those the person’s own people go to: where they’re a regular, where their plans went, where friends went in the last year (in plans the person can see). Schwifty is for plans with the people you pick, so the places they know come first.
- Then the places Schwifty groups went to in the last 12 months, the most first, as groups’ own choices are the best sign of a place that works for groups.
- Then the places the plan’s name points to (“padel” brings up padel courts).
- Then the nearest, as groups go where it’s easy to get to. Among places that fit as well, a place on Schwifty counts as 300 metres nearer and is marked On Schwifty, as it answers groups here: it comes first among equals, never above the places the person’s own people go to, nor lifting one that’s far away or doesn’t fit the plan.
- Places closed when the plan starts, by their listing’s hours, come last, as a group couldn’t go.
Up to 15 show. People can narrow them down (open then, takes bookings, on Schwifty, where friends go). Searching for a place by its name shows what the map data finds for that name, the nearest first, in the map data’s own order.
Discover’s places, for the time someone picks: only places open then, of the kinds that fit the time and what the person’s into. Cafés, museums and games by day and bars at night show to everyone, and other kinds (restaurants, clubs, climbing gyms, courts, cinemas, parks…) to people whose interests point to them. The places of the person’s own people come first, then the kinds they’re into, then the rest, each kind’s nearest in turn and a few of each at most (eight bars, four cafés, museums or clubs, three of any other kind), so no kind fills the row. A place on Schwifty counts as 300 metres nearer, as above. Up to 15 show.
Events: night by night; within a night, those sold out after the others, then those that match what the person’s into, then those at places on Schwifty within 10 km, then the soonest.
Offers near someone: those that hold now or start in the next six hours, the soonest first, then the nearest.
Your events, offers and perk show with your place, among why it fits, but don’t move it up. What groups spend, ratings and anything not described here don’t change the order. Anyone can tell us a place doesn’t fit what it’s shown for, or has closed for good: a person on our team checks, and may stop showing it for that, or anywhere once it has closed. If that happens to your place while it’s on Schwifty, we tell you why, and you can tell us we got it wrong.
Treating places alike
Schwifty doesn’t sell goods or services of its own to the people who choose your place, and doesn’t own or control any place. Its team sometimes hosts plans to start a city: they’re plans like anyone’s, and change nothing about how places show. Places differ on Schwifty only as these terms say: a place on Schwifty is marked and counts as a little nearer, and a Founding venue has its sticker and its first year.
Schwifty offers nothing alongside what your place offers (no tickets, insurance or extras), and nobody else does through Schwifty. You can offer your own, such as tickets for your events on your own ticket site, linked from the event.
You’re free to offer the same things elsewhere, on any terms and at any price, on other apps or directly: nothing in these terms limits that.
What you see, and what you never see
What your place sees:
- its groups and their people, this month and since its first, and the kinds of plans they came for;
- for each group coming, and each booking or group’s code, the host’s first name, how many and when, and what a booking is for, with the host’s line;
- its regulars by first name, with their groups in the last year, and whoever brought it onto Schwifty;
- what Schwifty groups spent there this month, as one total and only from 3 groups (it moves once 3 more groups are in it, so no group’s bill shows), and last month’s;
- the companies on Schwifty whose people came there this month, from 3 groups each, by the badges people show to everyone;
- how many groups came while each of its offers held, never which;
- how many times each of its events’ pages was opened in the last 7 days, and about how many people each choice of who an event is for reaches, rounded to tens and never under ten.
What it never sees: who came, who was in a group, or with whom; anyone’s profile, contacts or messages; anything about people beyond the first names above.
What we keep and use: your place’s listing, who runs it and when it joined, what it posts, the terms it accepted, and what the plans at your place say about it (bookings and answers, counts, how each group picked it, what groups kept as spent there). We use it to run Schwifty and to count, in totals, how Schwifty is used. We never sell it, and there are no ads in Schwifty. Your place doesn’t see data about other places, or Schwifty’s figures across places. Personal data is handled as the privacy policy says.
Who else gets it: the companies that run parts of Schwifty for us, on our instructions, which the privacy policy lists and Schwifty can’t work without; Google, which we ask for your place’s photos by its name and where it is; and the People team of a company your place makes an offer to, who see that offer and can hide it from their people (you then see that it doesn’t show, never why). What your page and your events show, anyone can see.
Restricting, suspending or ending
We may restrict, suspend or end your place’s use of Schwifty, in part or as a whole, when:
- your place, or someone running it, breaks these terms, the community guidelines or the law;
- what it posts misleads people, or its offers or perks aren’t given as posted;
- bookings, counts or groups are faked, or Schwifty is used to deceive anyone;
- it puts people’s safety at risk;
- someone joined it who may not act for it;
- the law, or an authority’s order, requires it; or
- it has closed for good.
We do the least that fixes the problem: taking down or pausing an event, an offer or a photo; then not showing its events or offers for a while; then suspending your place on Schwifty for a while; and last, ending it, which takes your place off Schwifty. We never lower a place in the order as a measure.
We tell you why in writing, with the facts (what a report said, where one did) and the part of these terms it rests on: when a restriction or a suspension starts, and at least 30 days before we end your place’s use of Schwifty. We end it sooner only when the law requires it, when a serious breach means we can’t be expected to go on (fraud, or a danger to people), or when your place has broken these terms again and again; we then tell you why as we do it. If someone joined your place who may not act for it, we undo it at once.
You can always write back to support@schwifty.eu to explain, and a person on our team looks at it again. If we got it wrong, we put things back as they were, straight away, with everything your place had on Schwifty.
Leaving
Your place can leave whenever it likes. Each person can stop running it in the app (Place, then Stop running it), and to take your place off Schwifty altogether, write to support@schwifty.eu: we do it within a few days.
Once it has left, its own page, events, offers and perk are gone, nobody runs it on Schwifty any more, and its numbers can’t be seen, so note anything you’d like to keep first. Like any place, it can still be picked for plans, and keeps its public page from its listing and the plans held there, without the On Schwifty mark. We keep what the privacy policy says, for as long as it says.
If we ever close Schwifty, we’ll tell you at least 30 days before.
Questions and complaints
Write to support@schwifty.eu about anything, including a decision we made about your place or how Schwifty works for it. A person on our team reads every message and answers in writing, usually within a few days.
Schwifty is a small business, so the EU’s rules for online platforms don’t ask it to run a formal system for businesses’ complaints, or to name mediators. If we can’t settle a disagreement between us, we’re open to mediation by an independent mediator, in good faith; it never stops either of us from going to court.
Payments (coming)
Nobody pays through Schwifty yet, and these terms don’t cover payments. Before any place can take payments through Schwifty, these terms will gain a part for them: what taking payments costs, a Founding venue’s first year included, how refunds, payouts and invoices work, and who processes the payments. We’ll tell you at least 15 days before, longer if you need time to set things up, and taking payments will be your choice.
Our responsibility
We provide Schwifty as it is and work to keep it running well, but we can’t promise it will always be available or free of errors, or that groups will come, book or keep their bookings. We’re not responsible for what people do at your place, or for what’s between your place and its guests: what you sell, serve or offer them is yours to answer for, and so is following the laws for your business. Nothing in these terms limits responsibility where the law doesn’t allow it, such as for harm caused on purpose or through gross negligence.
How we write to you
Notices about your place (a change to these terms, or a decision about your place) go to it in writing: by email, to the address on its listing or website or one you give us, or by text to the number it joined with, and to the people who run it in the app and on its page.
Changes to these terms
Schwifty is in beta, and what it does for places will grow and change. When a change touches these terms, we tell your place at least 15 days before it applies, and longer when you need time to adapt. Until then you can leave, and the change doesn’t apply to your place. You can also accept it sooner, in the app or on your page; posting a new event or offer meanwhile counts as accepting it too, unless we gave you longer to adapt. We never change these terms for the time before a change, unless the law requires it or the change is only good for you. Only the law, or a sudden danger from fraud, malware, spam, a data breach or another security risk, can make a change apply sooner. Changes that only make the words clearer, without changing what they mean, need no notice. The date at the top is the version in force.
Law
Italian law governs these terms. Rules that protect your business and that can’t be set aside by agreement, such as the EU’s rules for businesses on online platforms, apply all the same. Before going to court, write to us: most things can be sorted out.
