Terms of use

These terms are the agreement between you and Schwifty for using the app and the website schwifty.eu. By creating an account, you accept them together with the community guidelines, which are part of them. The privacy policy explains what we do with your data.
Schwifty is run by Miguel Castellano Merino, in Italy (“we”). You can reach us at support@schwifty.eu, in English, Italian, Spanish or German. It’s also our point of contact for authorities, and for anyone who wants to tell us about illegal content.
A beta
Schwifty is in a closed beta. Things will change, features may come and go, and the app may sometimes be unavailable. We’ll take care not to lose anything you’ve added, and we’ll tell you in the app before changes that affect you.
Who can use Schwifty
- You must be 18 or older.
- One account per person, with your real first name, your own photos and your real birthday.
- During the beta, signing up needs a mobile number from Europe. If you live here with a number from somewhere else, write to us.
- Your account is yours alone. Keep your phone secure, and tell us if you think someone else is using it.
Schwifty is free.
Plans and meeting people
Schwifty helps people make plans together. The plans themselves are between the people who make and join them: we don’t organise, supervise or attend them, and beyond the one-time phone check we don’t verify who people are. Use your judgement: meet in public places when you don’t know people yet, tell someone where you’re going, and leave whenever you want to.
Hosts decide who joins their plans. When a plan has costs, the app shows them, but no money goes through Schwifty: you settle them among yourselves. Costs are for sharing, never for profit.
What you post
What you post stays yours: photos, plans, messages and everything else. You give us a free, non-exclusive licence to store it, to show it to the people who can see it under the app’s rules, and to make the copies needed for that (smaller versions of photos, for instance), for as long as it’s on Schwifty. The licence ends when you delete it or your account; copies in backups are gone within 14 days.
Only post what’s yours to share, and what follows these terms and the community guidelines. Nothing illegal, and no commercial use: no promotions, ticket sales, paid events, advertising or recruiting.
Moderation
We can take down content, and restrict or suspend accounts, that break these terms, the community guidelines or the law. This is how:
- Photos are checked automatically when they’re uploaded, for nudity, violence and hate symbols. A photo that fails is refused.
- Reports. Anyone using the app can report a person, a plan, a group or a message, and a person on our team looks at every report. Anyone, with or without an account, can also tell us about illegal content by email: say where it is and why you believe it’s illegal, give your name and email address, and confirm that you’re reporting in good faith.
- Decisions. We decide in proportion to what happened and its context: we dismiss the report, take down a plan, a group or a message, or suspend the account. We tell the person affected what we did and why, in Activity or, for a suspension, when they try to sign in. They can reply to support@schwifty.eu within six months, and a person looks at it again.
- Repeatedly posting clearly illegal content, or repeatedly sending reports that are clearly unfounded, can lead to a suspension.
Ending things
You can delete your account at any time in the app, under You. We can suspend or close an account that seriously or repeatedly breaks these terms, and we’ll say why. If we ever close Schwifty, we’ll tell you at least 30 days before.
Our responsibility
We provide Schwifty as it is and work to keep it running well, but we can’t promise it will always be available or free of errors. We’re not responsible for what people do on Schwifty or at plans, or for losses caused by other people.
Nothing in these terms limits our responsibility where the law doesn’t allow it: for harm we cause on purpose or through gross negligence, for death or personal injury, or under consumer protection law. As a consumer, you keep every right the law where you live gives you.
Our name and app
Schwifty’s name, logo, app and website are ours. These terms let you use them as intended, and give you no other rights over them.
Changes to these terms
If we change these terms in a way that matters, we’ll tell you in the app at least 15 days before the change applies. If you don’t agree with it, you can delete your account before then.
Law and disputes
Italian law governs these terms. If you live in the European Union, the mandatory rules of your own country still protect you, and you can take a dispute to the courts where you live. Before that, write to us: most things can be sorted out.
